Quién paga el error?

In Brussels, Howrey counsel Álvaro Ramos and associate Elvira Aliende Rodriguez published the article “Quién paga el error?” in the Spanish financial newspaper Cinco Días. The article comments on the recent ECJ judgment in Schneider partially annulling the previous CFI ruling and in particular overruling the CFI demand that the Commission pay two-thirds of the losses Schneider incurred when it was forced to sell Legrand after the merger was blocked. The article also explains the legal principle in relation to the damages the Commission may be obliged to pay for a flawed antitrust decision.
