Partner
David Long is a partner in the Intellectual Property practice group at Howrey LLP. He focuses on complex patent litigation. He actively represents clients in various district courts, the Federal Circuit, the U.S. Supreme Court and the U.S. Patent & Trademark Office.
Mr. Long has experience in issues unique to patent litigation, such as strategies for (i) relying on advice of counsel to defend against a charge of willful infringement, ii) seeking or avoiding a preliminary injunction in medical product cases, (iii) seeking or avoiding bifurcation of liability, damages and willfulness issues, and (iv) Markman claim construction hearings.
Mr. Long also has represented amicus curiæ in the U.S. Court of Appeals for the Federal Circuit and the U.S. Supreme Court concerning significant patent issues.
Mr. Long has litigated technology ranging from complex electrical circuits to simple mechanical devices. His past representation involved automatic voice systems, wireless communication systems, signal processing systems, memory devices, integrated circuit designs, digital and analog circuit designs, computer software systems, manufacturing systems, medical products and office furniture. Mr. Long also counsels clients on patent related issues, such as licensing, product clearance and product redesigns.
In addition, Mr. Long publishes timely case alert commentaries on significant developments in patent law and has been a frequently sought commentator on patent law for mainstream and intellectual property media.
Prior to entering the legal profession, Mr. Long earned an advanced degree in electrical engineering. His studies emphasized electronic circuit design, advanced digital signal processing, communication systems, artificial intelligence and computer programming. He has over five years of experience in the field of electrical engineering based on his work in telecommunications, control systems, guided rockets and radar systems.

- On Demand Machine Corp. v. Ingram Industries, Inc. Represented defendant Ingram Industries on appeal from trial judgment of infringement by book manufacturing system, resulting in complete reversal on appeal and judgment of no infringement.

Prepared and filed amicus curiae brief on intersection of patent law and antitrust law on behalf of the Patent, Trademark & Copyright Section of the Bar Association of the District of Columbia.
- NTP v. Research In Motion, Ltd. Represented maker of BlackBerry e-mail system after adverse jury trial leading to substantial reduction of liability on appeal and favorable settlement.
