Co-Chair, Intellectual Property
Alan Grimaldi joined the firm in 1972 and is Co-Chair of the firm’s Intellectual Property practice group and former Co-Chair of the Commercial Trial practice group. Mr. Grimaldi is one of the firm’s senior trial lawyers. Recent accomplishments include a $76 million judgment against the United States in a breach of contract case for a Midwestern banking client and the fifth anniversary of leading one of the largest Intellectual Property practices worldwide.
Mr. Grimaldi has also had significant experience in all aspects of private and government antitrust and other complex commercial litigation including nationwide class action litigation, multi-district litigation in federal and state courts, grand juries, federal and state administrative agency litigation, unfair competition, insurance coverage, products liability and litigation dealing with trade-related matters.
Mr. Grimaldi has also had extensive experience in matters involving technical issues and has represented many clients in patent and other intellectual property litigation. As Co-Chair of the firm’s Intellectual Property group, he is responsible for one of the largest full-service litigation, patent, transactional and trademark groups in the United States. He has extensive experience in litigation, as well as mediation and arbitration, for IP clients in the consumer goods, electronics, defense and drug industries.
His clients include participants in the major manufacturing, banking, electronics, consumer products, beverage industries, environmental services and pollution clean-up, as well as energy and oil, industries.
Mr. Grimaldi has also been a strong supporter and advocate of the firm’s award-winning Diversity and Pro Bono programs.

Representative Highlights
- Government of Puerto Rico (DACO) v. Texaco, et al. Prevailed in a (D.P.R.) trial in Federal Court in an action for substantial damages against Texaco and others for an improvidently granted injunction relating to price controls. Judgment for Texaco, et al.; Aff’d by First Circuit.
- Fifth Third Bank v. U.S. After a 12-year, two-trial battle against the government, Mr. Grimaldi led a trial team in 2006 to a $76 million judgment in a breach of contract case on behalf of a financial institution. (COFC, CAFC)
- Aguilar v. Texaco, et al. Represented Texaco against a consumer class, consisting of 20 million purchasers of gasoline in California, alleging a conspiracy among all refiners to raise the price of gasoline. Defeated the claim on summary judgment. The decision was affirmed by Supreme Court of California.
